The OAB of São Paulo issued a public note, signed by president Luiz Flávio Borges D'urso, in which it expressed its indignation at some measures taken by the Public Defender's Office in relation to the Legal Assistance Agreement. The agreement was signed between OAB-SP and the State Public Defender's Office and provides legal assistance to needy people. Among the proposals in the note is to remove the management of the Defense Agreement, bringing it to the Department of Justice.
According to D'Urso, the statements and communications from the Public Defender's Office have been unilaterally modifying the conditions of the agreement, resulting in damage to the legal profession, such as the postponement, without reason, of the payment of fees.
The Defender’s Office counter-argued this part of the note. He stated that monthly meetings are held with the Order to discuss details about the agreement, which, according to the Defense Office, serves as proof that the decisions are not BTC Number Data unilateral. He even made the minutes of the meeting available, in which the topic on the agenda was precisely the explanation for the delay in paying lawyers.
It is also cited as an example, in the note signed by D'Urso, that of the thousand certificates issued by the Judiciary to pay lawyers in September, thousand were unfairly .
Regarding the delay in paying lawyers, the Defender's Office assesses that it is a reaction to the process of analyzing the regularity of all certificates that generate payments to lawyers registered in the agreement. “Payment is not so automatic, the Public Defender’s Office needs to analyze who is paying and why”, explains public defender Rodrigo Nitrini.
The Defender's Office argued that during this process (of analyzing the certificates), it was found that some of them had inconsistencies and irregularities, because they were filled out without all the necessary information. The note states that there were also cases of payment requests for situations not covered by the terms of the agreement or cases of duplicate certificates.
Also according to the note from the Public Defender's Office, “this procedure has ensured good management of the treasury, which remunerates professionals, with positive results. To illustrate the volume of amounts involved, until last July, the Public Defender's Office paid a total of R$ million in , an average of R$ million per month” to the OAB-SP.
